scope of supply

This incident is quite unique. The story / background is really long winded, so to cut story short, this is how the story goes...

For a requirement of one of the oversea project I am handling, I purchased an equipment from a supplier in Singapore as they were the main agent / distributor. As supplier, they played their part and delivered their equipments and have it shipped all the way to site and we had installed it.

As technology developed, the equipment came with some Programmable Logical Controller (PLC) to have all the process automated. It is partially our mistake we did an inspection (physically & visual) the equipment was acceptable prior to shipment, without testing the PLC. When we were about to test run / commission the equipment, only we came to know that the PLC programme is not loaded into it.

Then, when I contacted this supplier, only he came to inform me that the programming is not their scope of supply and that we have to pay additional USDxx,xxx.00 for the program, telling me it is proprietary etc etc

My blood pressure shot through the ceiling and we argued over the phone for about 2 hours and of course me being in the field for so many years or aka "old bird", I won the arguement and they finally says that they will send the program to be loaded into the PLC saving me USDxx,xxx.00.

Good news for my company saving the USD, but bad news to the supplier, they now ended up in my 'black-list' just for not thinking before talking.
